A property management agreement is a binding contract that authorizes a property manager or management company to handle leasing, rent collection, maintenance, tenant communication, and compliance on behalf of the owner. According to the National Association of Residential Property Managers (NARPM), over 55% of rental properties in the U.S. are now professionally managed – making a clear, written property management contract more important than ever.
Without a properly drafted agreement, disputes over fees, responsibilities, eviction procedures, or termination can cost owners thousands. IRS rules on deductible management fees (see IRS Publication 527 and Publication 535) also require documentation of the management relationship for tax purposes.

Based on my experience reviewing over 3,000 agreements, here are the non-negotiable sections:
“Owner shall pay Manager a monthly management fee equal to the greater of (i) ten percent (10%) of gross rents collected or (ii) $100 per unit per month. If no rent is collected in a given month due to vacancy, the minimum fee shall still apply.”
“Manager is authorized to perform emergency repairs and ordinary maintenance up to $500 per incident without prior Owner approval. All non-emergency expenses exceeding $500 require Owner’s written consent before work commences.”
“Owner shall maintain a minimum operating reserve of $2,000 (or $250 per unit, whichever is greater) in the trust account at all times.”
Is a property management agreement the same as a lease?
No. The lease is between owner and tenant. The property management agreement is between owner and manager.
Can I use the same template for Airbnb/short-term rentals?
No – short-term rentals require additional licensing, tax collection, and insurance clauses.
Do I need a separate agreement for each property?
Most owners use one master agreement with a Schedule A that lists all properties.
