As a business and real estate attorney who has drafted hundreds of eviction documents in Nevada over the past 12 years, I know how stressful the eviction process can be for landlords. One small mistake on a notice to vacate in Nevada can delay your case by weeks or even months and cost you thousands in lost rent. That’s why I created this completely free, attorney-reviewed Nevada eviction notice form package that is fully compliant with Nevada Revised Statutes (NRS) Chapter 40 as of November 2025.

In this comprehensive guide, you’ll learn exactly how to evict someone in Nevada, which notice is required in your situation, and how to avoid the most common (and expensive) mistakes I see landlords make every week in Las Vegas and Reno justice courts.

Understanding the Nevada Eviction Process in 2025: Step-by-Step

Nevada is one of the fastest states for landlord evictions when everything is done correctly. A typical no-pay eviction in Clark County can be completed in 21-35 days from notice to lockout. Here’s the exact timeline I follow for my clients:

1. Serve Proper Notice5-Day Pay or Quit most commonDay 1
2. File Summary EvictionAfter notice expiresDay 6+
3. Tenant Answer Deadline5-12 judicial daysVaries

Which Nevada Eviction Notice Do You Need? (2025 Requirements)

5-Day Notice to Pay Rent or Quit – Most Common

The 5-day eviction notice Nevada landlords use 90% of the time. Required when tenant fails to pay rent. Must include exact amount owed (including only rent and approved late fees – no “junk fees”). Source: NRS 40.2516 and IRS guidance on reportable rent payments.

30-Day Notice to Vacate Nevada – No-Fault Termination

Use the 30 day eviction notice Nevada template when ending a month-to-month tenancy or when the fixed-term lease has a “no-cause” clause after the initial term. During the first year of a lease, you generally cannot use a no-cause notice unless the lease specifically allows it.

7-Day Notice to Cure or Quit – Lease Violations

For non-rent violations (unauthorized pets, noise, unauthorized occupants, etc.). Tenant gets 7 days to fix the problem or move out.

5-Day Notice for Nuisance or Illegal Activity

No cure period allowed for substantial nuisances or illegal activity on the premises (drugs, assaults, etc.).

Common Mistakes That Will Get Your Nevada Eviction Case Dismissed

In my practice, these are the top 5 reasons eviction cases are thrown out in Nevada:

  1. Wrong notice period or type
  2. Accepting partial rent after serving 5-day pay notice (waives the notice)
  3. Mathematical errors in rent amount owed
  4. Improper service (must be personal or posted + mailed)
  5. Filing before the judicial day count expires

How to Properly Serve an Eviction Notice in Nevada

NRS 40.280 requires one of three methods:

I always recommend using a professional process server for $50-75 – worth every penny to avoid “I was never served” defenses.

Frequently Asked Questions About Nevada Eviction Notices

Can I use a 3-day notice in Nevada?
Only in very limited circumstances (holdover tenants after foreclosure, etc.). The standard is 5 days for non-payment.

Do weekends count in the 5-day notice?
No. Nevada uses “judicial days” – exclude weekends and holidays.

Can I change the locks myself?
Absolutely not. Only the constable/sheriff can perform lockouts after court order. Self-help evictions are illegal.

Is the Nevada 30-day notice different for Las Vegas vs Reno?
No. State law controls notice periods statewide.
