NO SMOKING ADDENDUM Tenant(s) and all members of Tenant’s household, guests, and invitees agree that smoking is strictly prohibited in any portion of the rental premises, including individual units, interior common areas, exterior balconies/patios (whether enclosed or unenclosed), and all outdoor areas within 25 feet of building entrances, exits, and operable windows. “Smoking” means inhaling, exhaling, breathing, burning, or carrying any lighted or heated cigar, cigarette, pipe, electronic cigarette, vape pen, or any other lighted or heated tobacco or plant product intended for inhalation, including marijuana, whether natural or synthetic. |
Yes – 100% legal nationwide. The U.S. Department of Housing and Urban Development (HUD) mandated smoke-free policies in all public housing effective July 31, 2018 (HUD Notice PIH-2017-03). Private landlords have always had the right to ban smoking as a property rule.

Existing tenants: You cannot unilaterally change material terms mid-lease. Best practices I’ve used successfully:
New tenants: Simply attach the no smoking lease addendum as part of the original lease package. Both documents must be signed before move-in.
In my eviction practice, here are the three elements that make enforcement virtually bulletproof:
Keep dated photos, neighbor complaints, and maintenance reports. Three documented violations are usually sufficient for lease termination in most jurisdictions.
FHA and ADA do NOT require landlords to permit on-site smoking of marijuana, even with a medical card. The First Circuit (2019) and Ninth Circuit (2021) both ruled that smoking is not a reasonable accommodation when a total ban exists.

Can I ban only tobacco but allow marijuana?
Technically yes, but I never recommend it – odor and enforcement issues are identical.
Do I need to provide designated smoking areas?
No. You can ban smoking everywhere on the property (most successful policies do).
Can tenants smoke in their cars?
If parked on your property, you can prohibit it. Include parking areas in the addendum.
