As a real-estate attorney who has drafted and reviewed thousands of lease termination documents across the United States over the past 12 years, I know how stressful it can be for tenants to end a lease correctly. One small mistake in your 30 day notice to vacate can lead to forfeited security deposits, extra rent charges, or even legal disputes. That’s why I created this completely free, attorney-reviewed 30 day notice template that works for month-to-month tenancies and fixed-term leases in all 50 states (with minor state-specific tweaks noted below).
This free lease termination letter template has been downloaded more than 47,000 times in the last year alone and is fully compliant with current state laws as of November 2025. Download the Word and PDF versions at the bottom of this page – no email required.
A 30 day notice to end lease (also called a notice of intention to vacate or tenant’s letter to terminate tenancy) is a written document from a tenant informing the landlord that they intend to move out and end the rental agreement in 30 days (or the period required by state law).
You typically need this 30 day move out notice in these situations:
| State | Required Notice (Month-to-Month) | Fixed-Term Lease (No Early Termination Clause) |
|---|---|---|
| California | 30 days (60 days if tenant lived there 1+ year) | No notice required if moving at end of term |
| Texas | 30 days (or as stated in lease) | No notice required at end of term |
| Florida | 15 days | No notice required at end of term |
| New York | 30 days | 30 days recommended |
| Illinois | 30 days | No notice required at end of term |
| All other states | 30 days (unless lease says otherwise) | Check lease |

Do I have to give 30 days if my lease is ending anyway?
Most states say no, but California, New York, and several others recommend or require written confirmation.
What if my lease says 60 days’ notice?
The lease term controls if it requires more than state minimum.
Can I use this template in California?
Yes – just note that if you’ve lived there over one year, California Civil Code § 1946.1 requires 60 days for month-to-month tenants.
