Under U.S. common law and virtually every state statute, performing surgery without valid informed consent constitutes battery or medical negligence.
The American Medical Association (AMA) Code of Medical Ethics Opinion 2.1.1 and the Centers for Medicare & Medicaid Services (CMS) at 42 CFR § 482.51(b)(2) explicitly require written documentation of informed consent for all surgical procedures performed under anesthesia or involving significant risk.
