In Colorado, almost every residential eviction (known as “Forcible Entry and Detainer” or FED) must begin with a written Notice to Quit or Notice to Vacate. The notice gives the tenant a final chance to cure the violation or move out before you can file in court. Serving an incorrect or outdated notice is the #1 reason Colorado eviction cases are dismissed.

A 30 day eviction notice Colorado is used to terminate a month-to-month tenancy when there is no lease violation (“no-fault” eviction). Key 2025 rules:

If your tenant has a fixed-term lease that is expiring, you generally do not need to give a 30-day notice unless the lease says otherwise.
A 3 day eviction notice Colorado (officially “3-Day Notice to Quit”) is used for substantial or repeated lease violations, including:
The 3-day notice is non-curable — the tenant must vacate; they cannot fix the issue and stay.

Despite the popularity of the “3 day notice to quit Colorado,” the majority of Colorado evictions actually start with a 10-Day Notice to Pay or Quit for non-payment of rent.
Under C.R.S. § 13-40-104(1)(d), if rent is late, you may serve a 10-day notice demanding payment within 10 days or vacate. If the tenant pays within the 10 days, they cure the breach and you cannot proceed with eviction for that particular non-payment.
Colorado law requires “proper service” or your case will be dismissed. Acceptable methods:

Can I use a 3-day notice for non-payment of rent?
No. First non-payment requires a 10-day notice (2025). Only a second non-payment within 12 months allows a 3-day notice.
Is there still a 30-day notice for all month-to-month tenants?
No. New 2024-tier system applies to tenancies that began on or after July 1, 2024.
Do I need a lawyer to evict in Colorado?
