Pro Tip from 12 Years of Practice: Even if your state allows subletting without permission, always get written landlord consent. I’ve seen hundreds of evictions avoided with a simple one-paragraph approval letter.
Enter the sublessor (you), sublessee (new tenant), and full rental address. Include apartment number and any parking space numbers.
Never make the sublease longer than your remaining master lease term. Example: If your lease ends August 31, 2026, the sublease cannot go past August 30, 2026.
You may charge more or less than you’re your original rent (called “sublease profit”). If you do, you must report the profit as rental income on Schedule E (IRS Publication 527 – Residential Rental Property).
State law caps apply. California limits to 2 months’s rent for unfurnished units (Civil Code § 1950.5). New York now caps at one month (2019 Housing Stability Act).
