{"id":6807,"date":"2022-09-20T13:29:44","date_gmt":"2022-09-20T18:29:44","guid":{"rendered":"https:\/\/coparmexjal.org.mx\/entorno-empresarial\/?p=6807"},"modified":"2022-09-27T14:22:11","modified_gmt":"2022-09-27T19:22:11","slug":"violencia-laboral","status":"publish","type":"post","link":"https:\/\/coparmexjal.org.mx\/entorno-empresarial\/violencia-laboral\/","title":{"rendered":"Violencia Laboral"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p>En el Art\u00edculo 2\u00ba. de la Ley Federal del Trabajo, se establece que el trabajo digno o decente es aqu\u00e9l en el que se respeta plenamente la dignidad humana del trabajador; no existe discriminaci\u00f3n por origen \u00e9tnico o nacional, g\u00e9nero, edad, discapacidad, condici\u00f3n social, condiciones de salud, religi\u00f3n, condici\u00f3n migratoria, opiniones, preferencias sexuales o estado civil; se tiene acceso a la seguridad social y se percibe un salario remunerador; se recibe capacitaci\u00f3n continua para el incremento de la productividad con beneficios compartidos, y se cuenta con condiciones \u00f3ptimas de seguridad e higiene para prevenir riesgos de trabajo.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>El trabajo digno o decente tambi\u00e9n incluye el respeto irrestricto a los derechos colectivos de los trabajadores, tales como la libertad de asociaci\u00f3n, autonom\u00eda, el derecho de huelga y de contrataci\u00f3n colectiva. Se tutela la igualdad sustantiva o de hecho de trabajadores y trabajadoras frente al patr\u00f3n. La igualdad sustantiva es la que se logra eliminando la discriminaci\u00f3n contra las mujeres que menoscaba o anula el reconocimiento, goce o ejercicio de sus derechos humanos y las libertades fundamentales en el \u00e1mbito laboral. Supone el acceso a las mismas oportunidades, considerando las diferencias biol\u00f3gicas, sociales y culturales de mujeres y hombres.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Por otra parte, en el Art. 3\u00ba., se menciona que el trabajo es un derecho y un deber social. No es art\u00edculo de comercio, y exige respeto para las libertades y dignidad de quien lo presta, as\u00ed como el reconocimiento a las diferencias entre hombres y mujeres para obtener su igualdad ante la ley. Debe efectuarse en condiciones que aseguren la vida digna y la salud para las y los trabajadores y sus familiares dependientes.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>El Hostigamiento y Acoso sexual son formas de violencia laboral y en espec\u00edfico, el Art. 3\u00ba.
