Every state in the U.S. (with the limited exception of certain oral open listings under $500 in a few jurisdictions) requires that listing forms for real estate involving broker compensation be in writing to be enforceable. The Statute of Frauds, codified in every state, specifically includes contracts for real estate commissions.
According to the National Association of Realtors® (NAR) 2024 Profile of Real Estate Firms, 89% of sellers used a real estate agent, and virtually all of those relationships began with a signed real estate listing form. A clear written agreement prevents the two most common disputes I see in practice: commission disagreements and unauthorized showings.

Include the agreed list price and a brief marketing outline (MLS, yard sign, virtual tours, etc.). While not required in every state, it sets expectations.
Start date, expiration date, and automatic renewal language (if desired). Most states allow protection periods (tail periods) of 30–180 days.
The commission section must clearly state the percentage or flat fee and when it is earned. Per IRS Publication 527 and Topic No. 701, real estate commissions paid to brokers are reported on Form 1099-NEC when $600 or more in a calendar year. Language requiring seller to complete state-mandated disclosure forms and clarifying cooperating broker compensation (usually 50/50 split or buyer-broker fee in post-NAR settlement world).
Critical for agents. If the seller sells to someone the broker introduced during the listing term within X days after expiration, commission is still owed.
Electronic signatures compliant with ESIGN Act and UETA are included, plus a placeholder for state-required addenda (lead paint, property condition, etc.).
