Oregon no longer uses the terms “custody” and “visitation.” Since 1999, the state has used “parenting time” and “legal decision-making” (ORS 107.101). When parents ask me “how to file for full custody in Oregon,” they usually mean one of two things:
According to the Oregon Judicial Department and Oregon DHS Child Welfare, courts start with the presumption that both parents should be involved unless there is evidence of abuse, neglect, or substance issues.
